Newhart sentenced in sex assault

A Rushville man will spend at least five months in prison, followed by three years of special probation for sexually assaulting a woman in Dimock in June 2007.

Roger Alan Newhart Sr., 49, was sentenced in the Susquehanna County Court of Common Pleas on Thursday. As part of the plea agreement, Newhart will be incarcerated in the county jail.

The victim did not appear in court but asked that her victim’s statement to be read by District Attorney Jason Legg at Newhart’s sentencing

The victim wrote, “Now let me ask, if someone broke into your house and took all of your valuable possessions, would you want to catch who did it? Would you want to put a stop to who did it? Would you want he return of those possessions? He invaded my body and practically stole my soul. So I think I have every right to want to see him pay for what he did. Then, in time, I too will regain my lost possession.

“He may blame me and hold me responsible for his consequences but he only has himself to blame for giving me this opportunity.”

The Susquehanna County Independent does not identify the victims of sexual assault.

Prior to sentencing, Newhart was evaluated by the Sexual Offenders Assessment Board. He did not meet the criteria to be labeled a sexually violent predator.

Others sentenced in the Susquehanna County Court of Common Pleas last week include:

Shawn Michael Ace, 38, Susquehanna,  to five to 23 ½ months in Susquehanna County Correctional Facility for Endangering the Welfare of a Child in Oakland Borough on January 7.

Richard Thomas Chapman, 26, Hallstead, to four to 23 ½ months in Susquehanna County Correctional Facility for Criminal Trespass in Hallstead Borough on May 8.

Michael H Smith, 50, Hallstead, to two to six months in Susquehanna County Correctional Facility with work release for Simple Assault in Silver Lake Township on March 21. Smith also received six months of probation to run consecutive to the above sentence for Disorderly Conduct in Silver Lake Township on March 21.

Freda Pratt, 50, Hop Bottom, to 15 months probation for Theft by Unlawful Taking in Forest City Borough on June 19, 2009.

Kevin J Markoff, 19, Montrose, to five to 23 ½ months in Susquehanna County Correctional Facility for Criminal Conspiracy/Theft by Unlawful Taking in Great Bend Township on October 27, 2009. Markoff also received three to 23 ½ months in Susquehanna County Correctional Facility to run concurrent to the above sentence, for Criminal Conspiracy/Criminal Trespass in Great Bend Township on October 27, 2009.

Daniel Raymond Parsons, 19, Montrose, to three to eight years in a state correctional facility followed by 10 years probation for Arson in Lenox Township on April 11, 2010.

Earl Harry Thompson, 36, Montrose, to six months probation for Theft by Unlawful Taking in New Milford Township on April 20, 2008.

Randall Paul Austin, 33, Montrose, to six months probation for Driving Under the Influence in Liberty Township on April 26. Austin also received 12 months probation to run consecutive to the above sentence, for Disorderly Conduct in Liberty Township on April 26.

Ashlee Weatherby, 27, Montrose, to 30 days to six months in Susquehanna County Correctional Facility for Driving Under the Influence in Forest City Borough on March 31.

David Richard Andersen, 28, Hallstead, to nine to 23 ½ months in Susquehanna County Correctional Facility for Delivery of a Controlled Substance in Great Bend Borough on January 7.

William Michael Leetz, 44, East Syracuse, N.Y., to four to 23 1/2 months in Susquehanna County Correctional Facility for Driving Under the Influence in New Milford Township on March 31.

Steve A Warner, 48, Montrose, to 60 days to 23 ½ months in Susquehanna County Correctional Facility for Recklessly Endangering Another Person in Bridgewater Township on January 16, 2010.

Jeffrey Lynn Branning, 53, Susquehanna, to five days to six months in Susquehanna County Correctional Facility, served on weekends for Driving Under the Influence in Oakland Borough on April 17.

William Scott Clarke, 32, South Gibson, to three days to six months in Susquehanna County Correctional Facility for Driving Under the Influence in Clifford Township on March 27.
