Susquehanna man charged in sex assault

Sex assault charges leveled against a Susquehanna man were bound over for trial Monday following a preliminary hearing in New Milford District Court.

Larry James Phillips Jr., 41, faces felony counts of involuntary deviate sexual intercourse and aggravated indecent assault in connection with incidents that allegedly occurred over six years ago, in New Milford.

Phillips also faces misdemeanor indecent assault charge of a minor under the age of 13.

The alleged victim told the court she was three to fours years of age at the time the alleged assaults occurred in 2003-04.

The Susquehanna County Independent does not identify the victims of sexual assault.

On the stand, the child said Phillips had told her to “kiss” his penis and put it in her mouth.

She also said that on one occasion Phillips had touched her “private area” with his thumb.

Under cross examination, the child told Public Defender Linda LaBarbara that she told her mother about the incident when she was about nine years old.

Following testimony, LaBarbara said there was a credibility issue that needed to be decided at the trial level.

Only the child offered testimony at the hearing.

According to the police affidavit, state troopers interviewed Phillips about the case on Jan. 26.

Phillips told police he was aware of the allegations that had been made against him.

He is free on $75,000 bail.

In May 2004, Phillips had been sentenced to serve up to five years in prison on a aggravated indecent assault charge that stemmed from a June 2003 incident in Great Bend.
