A 19-year-old Nicholson man has been accused of assaulting a state trooper March 11 while he was being taken into custody for public drunkenness in Dimock Twp.

Andrew John Huffsmith was charged with aggravated assault and resisting arrest by Tpr. Mark Mulvey.

According to a police affidavit, Troopers Eric Burns and T.J. Horan responded to a report of a fight on Baker Road at 9:20 p.m.

Residents in an apartment building told police they had attempted to subdue Huffsmith after he had fallen and passed out in a ditch near the dwelling.

According to the affidavit, the teen had been taken into one of the apartments and was unconscious on a couch.

Emergency services were called to evaluate Huffsmith and told police he was intoxicated and required no further medical attention.

Huffsmith was placed under arrest for public drunkenness.

According to police, Huffsmith lost his balance and began to pull away from Horan while being escorted to the police car.

Huffsmith then kneed Horan in the groin after police placed him against a refrigerator for his safety.

Huffsmith waived his March 14 preliminary hearing in Montrose District Court.

He is being held at the Susquehanna County Correctional Facility on $50,000 bail.
