Sex toy used in alleged assault

A 25-year-old Scranton man is charged with sexually assaulting a Susquehanna County woman after she apparently had been drinking and fell asleep.

Ivan Marrero has been charged with involuntary deviate sexual intercourse, indecent assault and sexual assault in an incident that happened this summer in South Gibson

The woman said Wednesday in Clifford District Courtbefore Judge Suzanne Brainard that a sex toy had been used on her.

The alleged victim took the stand, stating she had gone to bed with her boyfriend in the early morning hours of June 26.

She told the court she and her boyfriend engaged in intercourse and she fell asleep with the sexual device between her legs.

She said she awoke about an hour later and discovered Marrero leaning over her and using the sex toy to assault her.

Marrero left the residence when instructed by the victim’s boyfriend.

The woman than told the court she spoke with a neighbor about the incident who urged her to notify police.

Upon cross examination by Public Defender Linda LaBarbera, the victim admitted she had been drinking the night before and was drunk when she went to bed at about 6 a.m.

She also said Marrero never touched her with his hands but only with the sex toy.

The defense presented no witnesses.

LaBarbera told the court, “This is a matter of consent and a credibility issue that will be addressed at trial.”

He is currently being held in the Susquehanna County Correntional Facility on a probation violation.

Bail on the charges stemming from the June incident was set at $25,000.
