Misdemeanors land man back in state lock-up

District Attorney Jason Legg said Alex Gaskill was fresh out of state prison boot camp program when he committed thefts from motor vehicles and a simple assault in May and June 2010 incidents.

Gaskill, 20, Montrose, was sentenced by President Judge Kenneth Seamans to serve six to 23-1/2 months in the Susquehanna County Correctional Facility, credit for time served. He has been held at the county jail on bail since his June 23 arrest.

Gaskill will also be serving additional time on state prison on a parole violation. He was on parole when the May and June offenses occurred.

Defense attorney Patrick Daly said that although Gaskill pleaded no contest to the simple assault charge, he maintains he did not do it but in the interest of getting the sentence over with he chose to enter a plea.

Daly said Gaskill had previously committed minor thefts but had never before been accused of a violent crime.

Daly said, “He wants to get on with his life and get rehabilitation.”

Judge Seamans said, “You’ve got quite a sheet for someone your age. You’re only 20 years old.”

“You have to start doing better for yourself,” Seamans said. “Simple assault – that’s outrageous. If it wasn’t for you being sent back to state prison this sentence would have been substantially higher.”

Others sentenced Thursday in the Susquehanna County Court of Common Pleas included:

John H Wittenberg Jr., 22, of Hallstead, to 12 months probation for resisting arrest on July 31, 2010 in Silver Lake Township.  Wittenberg also received 27 days to 15 months to run concurrent for terroristic threats in Silver Lake Township on July 31, 2010.  He also received 27 days to 15 months, concurrent, for Simple Assault in Silver Lake Township on July 31, 2010.

Sarah Ann Briggs, 22, of Montrose, to 12 months probation for simple sssault in Susquehanna Borough on May 26, 2010.

Louis Edward Yachymiak, 30, of New Milford, to 15 months probation for Theft by Unlawful Taking in Brooklyn Township on October 19, 2009.

Shawn Allan Wood, 36, of Meshoppen, to 15 months probation for theft by unlawful taking in Bridgewater Township on July 17, 2010.

Bradley Saam, 24, of Carbondale, to 1 month to 12 months for theft by unlawful taking in Forest City Borough on June 30, 2010. Saam also received 1 month to 15 months, concurrent, for criminal trespass in Forest City Borough on June 30, 2010.

Neil D Ayers, 40, of Hallstead, to 12 months probation for theft by deception in Hallstead Borough on September 1, 2005.

Jason P Helvig, 26, of Montrose, to 5 days to 6 months for driving under the influence in Rush Township on April 24, 2010.

Timothy Murray, 48, of Montrose, to 90 days to 18 months for driving under the influence in Montrose Borough on August 1, 2010.

Margarito Chavez, 42, of Scranton, to 2 days to 6 months for driving under the influence in Montrose Borough on May 1, 2010.

Oscar Sevilla-Chavez, 22, of Scranton, to 3 days to 6 months for driving under the influence in Silver Lake Township on June 17, 2010.

Brian M Micks, 39, of Montrose, to 5 days to 6 months for driving under the influence in Hallstead Borough on July 11, 2010.

Richard Malone, 45, of Clifford, to 9 months to 24 months minus 1 day for driving under the influence in Montrose Borough on July 17, 2010
